Terms and Conditions for Brain Games Hub

1. Interpretation and Definitions

Interpretation

Words with capitalized initial letters have meanings defined under the following conditions. These definitions apply whether the terms appear in singular or plural form.

Definitions

• "Account" means the account you establish when you register to use the App.
• "App" or "Service" refers to the "Brain Games Hub" mobile application, available on the Apple App Store.
• "Apple App Store" means the digital distribution platform operated by Apple Inc.
• "Company" refers to Mad Brain Games Ltd.
• "Loyalty Points" means the virtual in-game currency earned through the App.
• "Device" means any device that can access the Service.
• "Gaming Apps" refers to third-party games accessible through the App.
• "Offer Wall" means third-party offers available within the App.
• "Promotions" refers to sweepstakes, contests, lotteries, spin-to-win features, or special events.
• "Rewards" means real-world value (e.g., gift cards, PayPal cash) that Loyalty Points can be converted into.
• "Terms and Conditions" means these Terms forming the entire agreement.
• "User" or "You" means the individual accessing or using the Service.

2. Acknowledgment and Acceptance

By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the App.

3. Eligibility and Account

• You must be at least 18 years old.
• Only one (1) Account per person and household is allowed.
• Multi-accounting is strictly prohibited.
• You must provide accurate registration information.
• You are responsible for your Account credentials.
• You may request account deletion by emailing hub@braingames.support.

3.1 Eligibility and Children

The App is intended only for adults aged 18 or older. We do not knowingly collect data from individuals under 18.

4. About Brain Games Hub

Brain Games Hub enables participation in a rewards program where you earn Loyalty Points by:

• Playing Gaming Apps
• Interacting with advertisements
• Completing Offer Wall offers
• Participating in Challenges and Promotions

Loyalty Points may be converted into Rewards.

4.1 Nature of the Service – No Gambling

This App is a promotional rewards application and does not involve gambling. No purchase is required. Apple Inc. is not a sponsor of any rewards.

5. Earning Loyalty Points

• Playing third-party games
• Completing challenges
• Interacting with advertisements
• Participating in promotions

Completion does not guarantee Rewards. Validation is subject to tracking systems.

6. Nature of Loyalty Points

Loyalty Points are virtual, non-transferable, and have no monetary value. They may be modified or removed at any time by the Company.

7. Redeeming Rewards

• Conversion: No guaranteed conversion rate.
• Redemption: Via PayPal or gift card options.
• Fraud Prevention: Facial verification may be required.
• Minimum Activity: Minimum usage may be required.
• Processing Time: Typically within 5 business days.
• Forfeiture: Points and Rewards are forfeited upon termination.
• Expiration: Unredeemed Rewards expire after 1 year.
• Inactivity: Accounts inactive for 180 days may be deleted.
• Taxes: You are responsible for applicable taxes.

7.1 Account Inactivity

Accounts inactive for 180 days may be reset, including loss of Loyalty Points and Rewards.

8. In-App Purchases

In-app purchases are processed exclusively by Apple. Apple is responsible for billing and refunds.

9. User Conduct and Prohibited Activities

The App is available only to residents of the following countries:

United States, Canada, United Kingdom, Australia, New Zealand, Germany, France, Italy, Spain, Netherlands, Belgium, Sweden, Norway, Denmark, Finland, Switzerland, Austria, Ireland, Iceland, Portugal, Israel, Poland, Japan, South Korea, Singapore.

You agree NOT to:

• Use the App outside allowed countries
• Use cheats, bots, hacks, mods
• Use VPNs, proxies, emulators
• Use for commercial purposes
• Commit fraud or use fake identities
• Disrupt servers or security
• Harass other users
• Reverse engineer the App
• Violate applicable law

10. Intellectual Property

The App and its content are owned by Mad Brain Games Ltd. You are granted a limited personal-use license.

11. Third-Party Links and Advertising

We are not responsible for third-party content, privacy policies, or practices.

12. Disclaimer of Warranties and Limitation of Liability

AS IS: The App is provided "AS IS" without warranties.

No Guarantee: No guarantee of uninterrupted service or earnings.

Limitation of Liability: The Company is not liable for indirect or consequential damages.

Maximum Liability: Limited to the greater of $100 or the amount paid in the past six months.

13. Indemnification

You agree to indemnify and hold harmless Mad Brain Games Ltd.

14. Termination

We may suspend or terminate your Account at any time. Loyalty Points and Rewards will be forfeited upon termination.

15. Changes to These Terms

We may modify these Terms at any time. Continued use constitutes acceptance.

16. Governing Law and Dispute Resolution

• US Users: Governed by New York law.
• EEA / UK / CH Users: Governed by the laws of England and Wales.

17. General Provisions

• Severability: Invalid provisions do not affect others.
• Assignment: We may assign rights without consent.
• Entire Agreement: These Terms and Privacy Policy form the entire agreement.

Right of Withdrawal

You may withdraw from an in-app purchase within 14 days.

Effects of Withdrawal

Refunds will be issued within 14 days using the original payment method.

Loss of Right of Withdrawal

You lose the right if digital content delivery has begun with your consent.
